1. The buyer accepts the responsibility of caring for this kitten and providing properly for its welfare. The buyer agrees to follow the breeder's instructions on care, housing, diet, treatment and health.
2. The buyer agrees that this kitten will always receive prompt, top-notch medical care.
3. The buyer agrees to provide companionship for this kitten, never leaving it alone for long periods of time without human attention.
4. The buyer agrees to provide a generous amount of exercise for this kitten, to provide it with toys, and not to cage it.
5. The buyer agrees never to allow this kitten outdoors unless leashed and accompanied by a responsible person to supervise its freedom for its health and safety. Once a kitten goes outside it will always want to go outside. At this point in time, none of the breeder's cats go outside and they do not yearn to go outside.
6. Under no circumstances will the buyer sell, lease, trade, give away or otherwise transfer the possession or care of this cat to another party without express written permission of the seller. Exception: If the breeder approves of the new owner and receives a signed identical contract proved by the "Thorsgard Cattery"
7. If the kitten is not already altered, the buyer agrees never to breed this kitten, and to have it altered prior to reaching 8 months of age. Breeder to release registration certificate once proof of altering is received.
8. The buyer agrees never to declaw this kitten, and understands that declawing is a mutilation and a cruelty that is likely to alter the kitten's temperament and health.
9. The buyer agrees if any of the above terms are disregarded, that the breeder may reclaim this kitten without a refund of the purchase price. The buyer further agrees that if items 7 is disregarded and the kitten is bred, that the buyer must pay an additional $1,000.00 in damages to the breeder, that any offspring of this kitten are to be delivered to the breeder as the breeder's sole property, and that the breeder may also reclaim this kitten without refund. The buyer agrees to pay all court costs if this contract is litigated, and that any suit shall be tried in Iowa under Iowa’s law.
10. The breeder guarantees that the breeder's cattery is FeLV negative, that this kitten is presently free of disease, and that this kitten will be accepted for a full refund of purchase price if returned within three (3) working days with a veterinarian's certificate that this kitten has a health problem. The breeder warrants that this kitten is genetically sound, and will replace this kitten with another at no additional cost if this kitten ever dies of a genetic defect within one year of ownership and that said defect is evidenced in an autopsy report presented to the breeder. The buyer is responsible for the cost of the autopsy as well as any costs incurred in transporting the replacement kitten.
11. If the Feline Infectious Peritonitis (FIP) vaccination is given to this kitten/cat, all guarantees of this contract are null and void.
12. The breeder reserves the right of first refusal to reclaim this cat from the buyer without a refund of the sales price recited below if the buyer, for any reason, cannot keep this cat any longer. If the breeder collects any monies for the rehoming of the kitten/cat, this amount will be passed on to the buyer minus any expenses associated with the re-homing of the kitten/cat.
13. By signing this contract, the buyer acknowledges that they have examined Thorsgard's Health Warranty and agree to all of it's terms.
