The Perils of Pilar!

High drama is unfolding out at the MODA station in Modesto, California! After being placed on a lengthy paid suspension, Pilar Barton, the heroine [NOTE: Pilar has strongly objected to my use of the term "heroine" when referring to her. However, I call 'em like I see 'em so she'll just have to learn to live with a little embarrassment!] of the union organizing effort at MODA who almost singlehandedly delivered a clear majority of signed union cards from her station, has been fired! I first learned of her suspension during a phone call I received from the national Teamsters Union FedEx organizing campaign coordinator, Terry Meadows. I then talked to Pilar and learned of the particulars of her suspension. Had the story she told me come from someone I did not know as well or trust as implicitly as I do Pilar, I would not have believed my ears!

It was nothing less than sheer irony that the last article I did on this site about the lockers that are to be installed at the new GYY station barely preceded my learning about Pilar's situation! As you will read, FedEx's MODA (Modesto, CA.) management could not have timed their latest, and apparently final, outrage against Pilar any better to illustrate the validity of my locker article if I had scripted their actions myself! And though I hate the fact that Pilar's problems with FedEx management came to a head at a time when I could capitalize on them, it would be a great disservice to the visitors of my web site if I did not use Pilar's situation as clear evidence of topics I've discussed on this site. I also know that Pilar would want me to take full advantage of her misfortune, as she, perhaps more than any of us, realizes the importance of doing anything and everything to bring the truth to FedExers everywhere.

As any regular visitor to this web site knows, the devious methodology of management out at the Modesto station has already been documented twice before on this site. What you didn't know, however, is that Pilar has been writing to me on a regular basis and detailing many of the ongoing abuses she and her coworkers have been subjected to at the hands of MODA's managers and a couple of hourly employees whom management apparently gave free rein to as they continually harassed Pilar for her union activities and the support she constantly lent to her beleaguered coworkers. At the same time as Pilar has been sending me these reports, she's also been careful to document them for her own records as Pilar knew that management was gunning for her and the inevitable was only a matter of time.

Coincidentally, another locally active pro-union employee, Ed Murphy, with nearly 20 years of service to FedEx, was recently terminated for some trivial falsification issue regarding his delivery records. Phil Beckman (of "Expressed" fame) told me he had talked to Ed's brother who said that Ed was fired for something he believed just about every FedEx courier has either accidentally or deliberately done at one time or another in their careers at FedEx. I don't have the specifics of this case as yet, but when I get them I'll publish the details here. In the meantime, it might be amusing to start a "How are they going to get Kevin?" survey...

Just some of the kinds of things Pilar has appraised me of that have gone on out at MODA are;

1. Favored employees are regularly scheduled for 55 hours, casuals are being worked over 12 hours a day and part-time employees are putting in over 40 hours a week!
2. Managers failing to take disciplinary measures against anti-union employees who used profanity and disparaging language against her during work group meetings.
3. Management actually surreptitiously shadowing her in their own cars while she was running her route!
4. Management writing her up for a misdelivery! (I've never heard of such a thing in my entire 11 years at FedEx!)
5. Management calling her into the office and threatening disciplinary action for missed van scans on days where all the other employees at MODA had experienced identical van scan problems due to systemic problems with COSMOS!
6. Managers doing dex 8 scans on packages just to prevent them from being late and then delivering the same package only minutes later!
7. The area personnel representative badgering Pilar about things she said to a television reporter regarding the long hours we were all putting in during the UPS strike.
8. Management at MODA allowing an anti-union employee who literally snapped at the station, screamed out obscenities and even tried to strike a manager, to keep her job after simply suspending her for 5 days. (Meanwhile, out in Las Vegas, a pro-union employee was summarily terminated for mumbling the f-word to a leap candidate!)
9. Management at MODA allowing anti-union employees to distribute their own anti-union literature in employee mail boxes.
10. Management at MODA singling Pilar out and telling her that her shorts were too "short," ordering new ones for her, and demanding that she wear them as soon as they came in even though other female couriers at MODA were wearing shorts of the same length as those Pilar was told were too short! (Understand that Pilar is a strikingly beautiful and tall woman who would look like she had ten miles of legs even if she were wearing Bermuda shorts! Also understand that the manager who harassed her about the length of her shorts was a female manager. Sounds like someone didn't get enough "Meow Mix" to keep her content...)

On top of all this, here's a few excerpts of letters Pilar sent has sent to me over a period of months!

But our station is out of control. Everyone is angry, it's like total anarchy around there. The anger is so thick you could cut it with a knife. I think people have had their limit of being screwed over and lied to. Our District Director came and told us outright lies for 1/2 an hour solid. Even though we have so horribly outgrown our building it's not even safe anymore and have about 10 routes sorting and loading their freight outside - rain or 110 degree weather, she says we need to have at least 25 more routes outside before we can justify a larger facility. I said, "Won't the packages get wet?" Guess what her reply was? No, not a lie? But of course, she lied and said, "No, the packages won't get wet in the rain."

She lied about so many things it's hard to remember them all. She griped about cutting O.T. One of the couriers said, "The cartage agents get all our overtime!" Meanwhile, our truck washer makes $17.50 an hour! Almost $2.00 an hour more then a courier topped out that has been there 20 yrs...

I will probably be in the principal's office this morning as I gave one of our guys a copy of your latest articles off the clock in a non work area. The manager asked him to come in her office that she wanted to show him something on the computer. He left his duffle bag on top of his envelope with the web site articles in it out in the break room with a couple of other personal papers. While he was talking to the manager, the other manager grabbed the envelope and his personal papers. He went back and they were gone. Can you say "entrapment" boys and girls? Can you say "stealing"? He had to ask them about it because some of the stuff was his own important personal papers! The manager told him she confiscated the items because she suspected they were given to him in a non-work area. He said that I had done nothing wrong because he was off the clock in a non work area. She begged to differ! the nerve, the spineless tactics these people go to!

To add to that, one of our moles brings in the articles from your site to the other moles to show them how mean and divisive we are and how rude we are to Stevie. Hey, if he can show people the web site articles for the sake of his arguments so can I.

Just days prior to her being suspended, Pilar sent me this in an e-mail message...

they [upper management] have called for a complete audit [of MODA] - first one in 11 yrs. maybe someone in corporate just started to notice the smoke off in the distance toward MODA...

Today, in another message I received from Pilar, she said:

...the working day previous to my suspension I was told by my manager, "If I wanted to be a real prick I could have your jobs (meaning Chris and I) any time I want". Also I received an anonymous letter from a co-worker stating he has a copy of a comat from our District Director saying, "Let these idiots (speaking of the couriers at MODA) try to file GFT's, I'll overturn every one!"

Finally, just today, I received this e-mail from a MODA employee who wishes to remain anonymous.

To Whom it may concern:

If by chance you determine my true identity....please, PLEASE, do not reveal it to anyone. I'm already taking a risk by giving this information.

I am a fedex employee at the MODA station. I don't know if you are aware or not, but Pilar Barton was fired earlier this week -- Accused of theft. Because of the sensitive nature of this subject, and for the fear of my own job, I will not reveal my true identity nor any further details.

As a fellow employee, I respected Pilar's work ethic and thought of her as a friend, but she is no thief.

We may not have agreed on the issues regarding the union efforts in our station, but as a co-worker it alarmed me to see the swiftness in which she was terminated.

I also find it "questionable" that Pilar, being the leader of the union movement in the MODA station and especially disliked by management for doing so, was conveniently removed from her position -- effectively silenced by management.

I think someone in management had a score to settle with Pilar, and they settled it by firing her.

Something smells rotten in MODA.

Right now, most people reading this article will be picking their jaws up off of the floor! After being subjected to all the things I listed and reading the excerpts from her letters, it would have to shock any reasonable reader's sensibilities to finally learn that the reason Pilar was suspended and ultimately terminated was for THEFT!!!!! And while Pilar is prevented from relating the specific details of the case FedEx has slapped together against her because of prohibitions placed upon her by both her lawyer and FedEx, you can bet your last dollar that once the details are revealed, Pilar will emerge as yet another pro-union activist who was simply targeted and eliminated by a management team who found her too much of a threat to the status quo!

Clearly the writer of the anonymous letter I reprinted was making a gross understatement when he or she said that "something smells rotten in MODA." The Machiavellian machinations that pass for management out there make the folks at Peyton Place look like rank amateurs in the not-so-fine arts of back-stabbing, deceit and back room plotting! Even if you are the most staunch anti-union FedExer to ever sign onto a DADs unit, this article should be more than ample evidence to give you serious pause when next you contemplate the issues of job security and FedEx management integrity... Kinda gives my locker article a Nostradamus quality, doesn't it?

Literally hundreds of people have written me wonderful letters of praise about my work on this web site. Yet, the effort I put forth here pales when compared to the kinds of activism being engaged in by the unsung heroes and heroines of the organizing movement within FedEx! All I do is sit in the climate-controlled comfort of my den and engage in what amounts to therapeutic venting. However, like Bob Kutchko of Kansas City and Leanna and David Cochran of Indianapolis, Pilar has put herself squarely on the front lines by devoting her own time and resources to beard the lion in his own den. During the UPS strike, Pilar walked the picket lines with our UPS cousins and even organized a barbecue for them to let let them know that many of us at FedEx wholeheartedly supported their efforts and sacrifices! Gaylord Phillips, a Teamster's Union organizer who has worked closely with Pilar throughout her organizing efforts sent me this in an e-mail during the strike.

"Pilar has been great! She has come out to the picket line in Ceres almost every day!"

Despite what's happened to her, I'm not in the least bit worried about Pilar. Whatever happens, she's bound to come out smelling like the rose she indeed is! The best legal and employment resources of the Teamsters Union are firmly behind her. Her own business is also showing promising returns. Be assured that whatever her fate will be, I will be closely following future developments in her life and will keep you all informed of them.

As much as I'd like to conclude this article on an upbeat tone, I feel it is necessary to tell another part of Pilar's story. For as soon as she was suspended, I received an unbelievable e-mail from a piece of human debris that crawled out from under a rock and was even capable of eliciting shock from my thickly-calloused psyche! What makes that which you are about to read even more extraordinary is that it was written by a creature who doesn't even work at FedEx! But that's still not all the amazing background on this fellow! It's important that you understand that he and his wife (one of Pilar's coworkers) had actually been on friendly terms with Pilar and that his wife had gone to lunch with Pilar on several occasions! It never ceases to amaze me how cruel, deceitful and utterly devoid of compassion those who occupy the anti-union ranks can be... Hold your nose and read on!

Hello Pilar,

I heard from Terry Meadows last night that you had been suspended! I wanted to call you then, but somehow I couldn't find the particular message you had sent me with your phone number in it. I met with Terry tonight here in Chicago to discuss the upcoming national brainstorming meeting in November and got your number from him. I've tried calling your number several times tonight but it's always busy. We need to talk right away! I want to immediately put an article on the site about your situation and include in it all the devious little bull**** they've been doing to you lately! Terry says their lawyers are meeting to discuss your situation tomorrow and he seems assured that any way it goes for you, the Teamsters will give you every assistance at their disposal. I told Terry that FedExers would be watching how well the Teamsters treat you because you are such a high profile member of the organizing core at FedEx. I mentioned how well the UAW treated Al Ferrier when he got in trouble and I told him that FedExers will view that as a barometer by which we measure just how much the Teamsters value sacrifices made by FedExers in the organizing effort. All eyes will be upon you and our prayers will be with you! You are not now, nor will you ever be alone as you fight the bastards! I'll keep trying to call you and I hope you will try calling me until one of us manages to get through.

Will have to email you in the morning- so exhausted can't keep eyes open. Someone hacked into George Ground's computer. I called he and his wife because they're my friends. They knew nothing about the email and said their computer recently was hacked... everyone on their email address book was sent a nasty message regarding one thing or another. They must of done the same thing to you. It had to be a Fedex employee because George and Janice didn't even know about my suspension... thought I was out because of my back.... Danger - I smell a rat. I'll write you in a little bit.

Hi Pilar,

What follows is the complete message I got from George Ground. I'd love to know how someone "hacked" his computer. Generally that type of thing is pretty impossible unless one leaves one's machine unattended in a server or BBS type mode. Even at that, someone would have to know George's machine was in such a mode, know the phone number his machine was receiving on, and then know how to hack his server or BBS software. The only other possible way it *could* happen is if someone hacked his ISP server or knew George's user name and password on that same ISP. Seems that anyone that computer savvy would not be working at FedEx.... Are you absolutely certain George is shooting straight with you???

Hello Pilar,

Your "friend's" explanation sounds about as lame as the old "dog ate my homework" excuse. This stinks. Why not ask George if he plans on pressing charges against his "visitor" for breach of the Telecommunications Privacy Act? Like I believe that George turned a visitor in his home loose with his computer and simply left him alone while the visitor proceeded to send a bunch of messages out in his name without his knowledge or permission. Sorry Pilar, but I think your friend and his wife may not be the "friend's" you believe they are... I could be wrong, but the way it seems to add up now is that George is your Brutus...

In any event, while I understand that you are experiencing a lot of emotional turmoil now, I must tell you that I believe that timing is absolutely crucial now and that I need to put all this up on the site as soon as humanly possible. Please consult with your lawyer and try to get permission for me to relate the details of your situation as soon as humanly possible. I know you are running a business on the side, but let's not forget all the months of bull**** and harassment that led up to the situation you are in now. I know the temptation to put it behind you and move on with your life is an attractive one, but if we don't chronicle and embarrass all the bastards that put you in this situation in a timely fashion so that everyone in your station and throughout the system is made aware of the kind of devious machinations our management is capable of, we will have let them get away with this unscathed.

Please try to focus on getting me the details and permission as soon as you can Pilar.

Oh Pilar..
Guess we just have fundamentally different views on issues like "right to work" and questions regarding if unions are good for private enterprise and the national economy.

I don't feel that people have a right to work at a given job, if you do the job up to certain standards you get to keep you job, if you don't tick off the boss...unions all to often work to get some worthless worker his job back when by all rights he should have been "let go" a long time ago.

As for me "feeling that way about you"...This all started when I sent the administrator of the Fed-Up web page a barb. When I sent the e-mail there was not much info re: your fate.... I was curious to see what kind of twist he would put on the issue, since most of his views are twisted, so I put a little spice into it...hoping to "bait" him... and boy is he spine-less, he never responded to me , he runs with the e-mail to you..."Pilar look at what this guy said about you"... He seems kind of paranoid and conspiracy oriented to me.

If you want to know how I feel about you, I'll tell you, I feel bad about how much trouble and hassle the "union issue" has caused you... I believe that when you work for someone, for an hourly wage, you owe that person or entity a certain degree of loyalty, when you walk around the place of business running down the management, instead of trying to make constructive changes from within by working with management, your just asking for trouble... If it's so bad or unbearable for you, you should look for work elsewhere. I'm always wary of people who are going to try to make global changes for the good of all the little people (ie. union votes for an international company). I'm not happy that you are having trouble, and I never wrote to anyone that I was glad you were fired as you reported to Janice during your first phone call.

I don't know you well enough to have feelings about you, you seem like a nice person on the few times we have talked.

As for the Fed-up guy, I assume it's a guy, from looking at his web page it seems that he's hanging around Fed-ex just to be a "spoiler", to cause as much trouble as he can...he doesn't sound like he wants things to be better, he just likes controversy.

His latest deal about the lockers, he assumes that because they put in transparent lockers that they don't trust anybody. Who says you have a right to a locker in the first place. If you don't like it don't use it...The company owns the lockers, I say they can make them out of whatever they want to, and where security is an issue, they have a right to open them when they feel a need to.

So, I stand behind what I said, which was a request for information, are you going to try to tell me that your current trouble with the company is not related your actions or things that you have said? Had I been talking directly to you I would have asked the same questions, I would not have phrased the "alligator mouth with hummingbird brains" question the same way because I'm not usually so brutal as that...although I probably would have asked you face to face if it (your problems) was from running your mouth at the station

George,

I now understand that your message to me regarding Pilar's present situation was an effort on your part to "bait" me. While I find it curious enough that someone who doesn't even work for FedEx would be trying to get my goat in the first place, I find it stranger still that after making the attempt, you have so high an opinion of yourself that you would think I'd drop everything and immediately respond to your drivel and that upon not getting that immediate response you apparently longed for, you would then jump to the conclusion that it was due to my being "spine-less."

Now you're going to have to be patient with me here George, 'cause I'm obviously not as gifted as you are when it comes to judging other people's character so I may stumble in my logic and draw some erroneous conclusions. Having said that, being the stand-up kind of guy you obviously are, you'll be benevolent enough to point out any mistakes I might make in this response, won't you?

For starters, here's the conclusions I've drawn about you thus far. You're a coward, a liar, a back-stabbing cretin with the scruples of a jackal and when you got caught with your pants down around your ankles you engaged in a whole lot of self-righteous obfuscation in an attempt to explain yourself. You're a coward because you say things about Pilar behind her back that you never had the guts or grace to confront her with in person even though you had ample opportunities to do so because you had met and even socialized with Pilar. You're also a coward because you then began sputtering out things about me behind my back rather than writing to me directly and saying them. Seems you have a real problem with direct confrontation and that usually goes hand-in-hand with having a somewhat yellowish tinge down one's spinal column...

You're a liar because when I forwarded your "hummingbird brain and alligator mouth" message about Pilar to her, you told her that you didn't write it and that someone hacked your computer. You even tried to blame it on a coworker you claimed had been visiting your home. Finally, you fessed up and admitted you sent it, only you put it this way.

Seems like you don't have a very good command of the English language, do you George? You see, if you had sent me a personal dig or criticized something about the web site, that would have been a "barb." What you sent was a petty remark steeped in obvious satisfaction that someone "got axed" from their job. More importantly, what you sent was a window into your mind and I've got to tell you George, the view it affords is pretty pathetic! I cannot imagine a mentally healthy person deriving personal satisfaction in the knowledge that another human being had lost their livelihood while not even knowing anything at all about the details of the actual situation.

As for you being a back-stabbing cretin with the scruples of a jackal, you proved that when you treated Pilar kindly to her face, broke bread with her and created the impression that you were a friend only to take a cruel shot at her behind her back as soon as an opportunity afforded itself. I call you a jackal, because like that well-known scavenger, you were gleefully taking bites out of the corpse while it was still warm and you could have cared less than a whit as to the actual circumstances of the demise of beast whose carcass you were so quick to feast upon with such relish!

As for your engaging in self-righteous obfuscation, your efforts are pitifully obvious. You expound at-length about corporate loyalty, your views on unions and my personal agenda where the Fed Up web site is concerned while sniveling about how you wouldn't be so "brutal" as to make a statement that someone had "hummingbird brains and an alligator mouth." Yet, you admit that you did indeed send me a message. Well George, the first and *only* message I've ever received from you was the one I forwarded to Pilar. You can attempt to shroud what you did in a smoke screen of rhetoric about your views, but the fact remains that you sent a message which contained what you yourself characterized as "brutal" content.

I won't even attempt to dignify the things you said to Pilar about my motives where the web site is concerned with a response. My reasons for doing what I do have been stated and restated many places on the site. For you to draw the conclusions you did about my motives, you've either just skimmed over the site without even trying to seriously comprehend it or you simply lack the mental acuity to do so.

In closing I'll just say that I don't know what would compel you to feel so threatened by whatever Pilar has done in her relationship with FedEx any more than I can fathom why you would want to "bait" me or make snide remarks about me behind my back either. You don't work for FedEx, your wife does. If anyone has any legitimate right to question what either Pilar or I do in conjunction with our employment at FedEx, it would your wife. Yet, in all the time she's known Pilar, she has never made her opposition to Pilar's activities known. Nor has your wife ever written to me voicing her objection to my site. Furthermore, neither Pilar or I have ever tried to shove our beliefs down anyone's throat. In short, you've made a complete ass of yourself by taking pot shots at people who bore no malice whatsoever toward either you or your wife and you remain too full of yourself to arrive at that admission on your own. Geez, I kinda hate to burst your bubble George, but Sprynet's counter is pretty notorious for being erratic in its display and it sorta drops the first digit every now and then. Between the 13K hits on my CIS site and over 500 on the new mirror site, I'd say I'm doin' all right for a site as narrowly focused as mine is.... I sure hope you practice good podiatric hygiene George, because you seem to spend an awful lot of time with your foot in your mouth!

Ahhh... yes! The common practice of calling someone a diminutive name in order to attempt to assuage feelings of insecurity by creating the illusion of being in a position to talk down to them. Like I said in my first message to you George, you've opened a window into your your mind and the view is becoming more and more pathetic with every word you write.

Oops! There ya go again George! Making a complete ass of yourself by speaking of that which you know nothing about. I not only read the letter to Pilar over the phone before sending it to you, but I also sent her a copy. She wholeheartedly approved of what I sent you. Keep trying though George. Even a blind man is bound hit something eventually if he keeps taking shots. One little piece of advice though.... Try aiming a little higher once in a while. If you keep shooting yourself in the foot like this, pretty soon you won't have any toes left!

I don't think so George. Whatever happens to Pilar, she's going to come out of all this smelling like a rose and perhaps a much wealthier lady to boot! In fact, probably the worst case scenario for her would be that she were reinstated at FedEx!

Pilar is probably one of the most energetic, compassionate and altruistic human beings it has ever been my pleasure to know. If she has any failings at all, they would be limited to her almost naive trust in her fellow man. After all, she trusted you... She needs no pity though, so I'll keep it in reserve for those forced to live with you.

I just know you'll tell me you're too darn busy with work and all, but if you want to know the *real* truth, just check back on the web site every so often and the missing digit will pop up. In fact, you'll sometimes even see text appear that says something like "counter by Sprynet" when they decide to get into their advertising mode. Of course you really don't want to know the *real* truth, do you George?
